These Terms of Service (the “Agreement”) govern your access to and use of the services provided by Magic Dragon Charters, LLC (“Magic Dragon”). By accessing or using our services, you agree to be bound by the terms outlined in this Agreement.
Acceptance of Terms
By using Magic Dragon’s services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use our services. Magic Dragon reserves the right to modify this Agreement at any time, with changes taking effect upon posting to our website. Continued use of our services constitutes acceptance of the revised Agreement.
Definitions
Magic Dragon refers to Magic Dragon Charters, LLC, including its officers, directors, employees, agents, and affiliates.
Captain refers to the individual(s) assigned by Magic Dragon to operate the vessel.
Services include all offerings provided by Magic Dragon, including chartered boat services, transportation, and related experiences.
You refers to the user of Magic Dragon’s services.
Eligibility
To use our services, you must:
Be at least 18 years of age or the legal age of majority in your jurisdiction.
Have the authority to enter into this Agreement.
Use the services in compliance with all applicable laws and regulations.
Service Description
Magic Dragon provides chartered boating services, including captained excursions, private bookings, and group experiences. Magic Dragon is not a common carrier and does not provide transportation services in a commercial capacity.
User Responsibilities
You are responsible for the safety and behavior of all guests in your party.
You must comply with all safety instructions provided by the Captain.
Any damages caused to the vessel due to negligence or misconduct may result in additional charges.
Payment & Cancellations
Payment for services must be made in full at the time of booking unless otherwise agreed.
Cancellations made within [X] hours of departure may be subject to a cancellation fee.
Refund policies are outlined on our website and may be subject to change.
Liability & Assumption of Risk
Magic Dragon is not liable for personal injury, property damage, or other losses occurring during the charter.
You assume all risks associated with boating activities and agree to hold Magic Dragon harmless from any claims.
Privacy Policy
Magic Dragon collects and processes personal information in accordance with our Privacy Policy, available on our website here.
Termination
Magic Dragon reserves the right to refuse service or terminate this Agreement at any time for violations of these terms.
